These Terms of Service ("Terms") govern access to and use of the SimToNet website, member portal, virtual phone numbers, messaging and voice-related features, APIs, support, and related services (collectively, the "Services"). SimToNet is located in 104 Mai Thi Luu, Da Kao Ward, District 1, Ho Chi Minh City, Vietnam. Questions about these Terms may be sent to [email protected].
By visiting the website, creating an account, purchasing or renewing a number, using an API, or otherwise using the Services, you agree to these Terms and the following policies, which form part of these Terms:
If you do not agree, do not access or use the Services.
You must be at least 18 years old and legally capable of entering into a binding agreement. You must provide complete, current, and accurate account, identity, business, contact, payment, and intended-use information when requested. You may not register under a false identity, impersonate another person or organization, or conceal the party that will actually use a phone number.
You are responsible for maintaining the confidentiality of your credentials and API keys, restricting access to your account, and all activity performed through your account. Notify us immediately at [email protected] if you suspect unauthorized access or credential compromise.
SimToNet provides access to virtual phone-number functionality through independent telecommunications and technology providers. Available countries, capabilities, prices, number types, and service periods may change. A number is licensed for use during an active service period; it is not sold to you and you do not acquire ownership of it.
Unless SimToNet expressly states otherwise, the Services are not a replacement for a primary telephone service, do not support emergency calling, and must not be relied on for emergency, life-safety, medical, or other mission-critical communications.
SimToNet may request identity, address, business, beneficial-owner, payment, or intended-use information before or after activating a Service. Verification may be conducted by email. You must respond accurately and within the requested time. We may delay activation, limit functionality, reject an order, or suspend a number while a review is pending.
You may use a number only for the verified user and stated lawful purpose. You may not sell, sublicense, transfer, share, or make a number or account available to an undisclosed third party without prior written approval from SimToNet.
You must comply with all applicable laws, regulations, court orders, telecommunications standards, carrier rules, consent requirements, opt-out requirements, sanctions, export controls, and third-party rights in every jurisdiction affected by your use.
You are solely responsible for obtaining and retaining any consent required to send, receive, record, store, monitor, or process a communication. If you send messages, every recipient must have provided the consent required by applicable law and carrier policy. You must identify the sender when required and promptly honor all opt-out requests.
The Services may not be used for spam, scams, phishing, smishing, vishing, impersonation, harassment, traffic manipulation, unlawful surveillance, interception of credentials or verification codes, or any other prohibited activity described in our Acceptable Use Policy.
Phone numbers are regulated national resources. Their assignment, permitted use, identity requirements, address requirements, and capabilities depend on the relevant country and provider. You must submit requested end-user documents and keep them current. A provider or regulator may reject, replace, suspend, or withdraw a number, sometimes without advance notice. SimToNet does not guarantee that any particular number will remain available.
You may not port, transfer, reconfigure, spoof, or represent ownership of a number except through an authorized process. Caller ID and sender identity must be accurate and lawfully controlled by you.
Prices and renewal charges are displayed in the website or member portal and may vary by country, provider, number type, capability, and regulatory requirement. You authorize us to deduct applicable charges from your account balance. You are responsible for maintaining a sufficient balance before purchase or renewal.
A number may expire, be released, or become unavailable if it is not renewed on time. Except where required by law or expressly stated by SimToNet, completed purchases, renewals, usage charges, and accounts suspended for a policy violation are non-refundable. Provider outages, third-party blocking, and incompatibility with a particular website or application do not automatically qualify for a refund.
To operate and protect the Services, SimToNet and its providers may process account activity, traffic metadata, message or voice content, complaint information, and other relevant data as described in the Privacy Policy. We may investigate suspected abuse, request supporting information, preserve relevant records, and cooperate with carriers, service providers, regulators, courts, and law-enforcement authorities when legally required or reasonably necessary to protect users, third parties, or the Services.
We may immediately restrict, suspend, or terminate an account, API key, feature, or phone number if we reasonably believe that: information is inaccurate or incomplete; a payment is disputed or overdue; use violates these Terms or a provider rule; use creates security, fraud, legal, or reputational risk; a carrier or authority requests action; or immediate action is needed to prevent harm.
Depending on severity, enforcement may occur without prior notice. We may require additional verification before restoring access. Serious or repeated violations may result in permanent termination, loss of numbers, and denial of refunds to the extent permitted by law.
The Services depend on telecommunications carriers, cloud platforms, payment processors, analytics services, and other independent providers. Their terms and policies may apply to your use. SimToNet is not responsible for an independent provider's acts, omissions, routing, filtering, outages, number reclamation, delivery decisions, or service changes.
SimToNet and its licensors retain all rights in the website, software, documentation, branding, and related materials. Subject to these Terms, you receive a limited, revocable, non-exclusive, non-transferable right to use the Services for your approved purpose. You may not copy, reverse engineer, interfere with, or attempt to bypass restrictions in the Services.
To the maximum extent permitted by law, the Services are provided "as is" and "as available." SimToNet disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and message or call delivery. We do not warrant that a number will work with every third-party service, website, carrier, or verification system.
To the maximum extent permitted by law, SimToNet will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, communications, or business opportunities. SimToNet's aggregate liability arising from the Services will not exceed the amount you paid to SimToNet for the affected Service during the three months before the event giving rise to the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded.
To the extent permitted by law, you agree to defend, indemnify, and hold harmless SimToNet and its personnel and providers from claims, losses, penalties, costs, and reasonable legal fees arising from your use of the Services, your communications, your end users, your violation of these Terms, or your infringement of another person's rights.
We may modify the Services or these Terms to address legal, regulatory, provider, security, or operational changes. The updated effective date will be posted on this page. Material changes may also be communicated through the website, member portal, or email. Continued use after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. Subject to any mandatory consumer rights, disputes will be submitted to the competent courts in Ho Chi Minh City, Vietnam. If any provision is unenforceable, the remaining provisions remain in effect. Failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent.
